The use of electronic pages and services provided to the visitor/user from the website www.artcolour.gr owned by “Art & Colour (Grigoriadis Vassilios)” hereinafter “the company”, requires your unconditional agreement with the following terms of use, which apply to the entire content of this website. Consequently, the visitor/user must carefully read these terms before using the services of the website and if they do not agree, they must not use the services and content. The visitor/user is requested to check the content of the terms of use for possible changes. Continued use of the website www.artcolour.gr even after any changes means the unconditional acceptance of these terms by the visitor/user.

Our company’s purpose is to provide the best possible service to our customers. This electronic store (e-shop) gives the opportunity to both our customers and all Internet users to be immediately informed about the products offered by our company, as well as to make their purchases electronically.
Art & Colour reserves the right to unilaterally modify and update the terms and conditions of use of its website.

All website design, text, graphics, selection and settings constitute intellectual property of our company and are protected under relevant provisions of Greek law, European law and international conventions. All rights reserved, every text, image or trademark is registered and used in this electronic store under license from their respective owners.

Personal Data Protection Statement

In order to carry out any transaction through our company’s electronic store and to place orders for its products, disclosure of some personal data of the customer will be required. When placing an order, full name, product delivery address, billing address (if different from delivery address), billing details (if invoice payment is selected), contact telephone number, email address, and in cases where payment is made by credit card, the card number, expiration date and three-digit security code will be requested.

Disclosure of Data to Third Parties

This data is processed by the company in compliance with the 1995 EU Data Protection Directive (DPD), as well as the EU General Data Protection Regulation (GDPR) effective from May 25, 2018.

Credit card details are not stored on the company’s storage media during the transaction. Security

For your better security, we have chosen for the website www.artcolour.gr to be hosted on Google Cloud Platform infrastructure. The website www.artcolour.gr uses encryption, ensuring secure data transmission.

Payments with debit cards, credit cards, Apple Pay and Google Pay are made easily and quickly through a special area supported by Stripe, the global payment gateway for the Internet.

Payment with Paypal is carried out in a specially configured and secure area by Paypal.

Marketable Items – Availability – Characteristics

Products available for sale, their characteristics, prices and available stock are found at the electronic address www.artcolour.gr and are accessible to all. Users can search for more information about each product by clicking on the product icon. Our company guarantees timely customer information regarding product availability or non-availability, but bears no responsibility for their availability.
Our company makes every possible daily effort to provide all required information about each product (technical specifications, prices, etc.). However, to limit possible errors, we would recommend that before completing any purchase, you contact us in cases where prices or any other product characteristic are beyond usual and reasonable limits. The prices listed in the relevant catalogs next to each product include the applicable VAT.

In certain areas of Greece where reduced VAT rates apply and provided your purchase is made with an invoice, product prices are lower than those listed by the reduced VAT amount. Our company reserves the right to adjust the prices of its electronic store without being obliged to inform the consumer public.

Product Orders and Consumer Protection

Orders through the electronic store www.artcolour.gr constitute distance sales contracts, which are governed by the legislative framework of Law 2251/1994 (as currently in force) and amendments referenced in PD 131/2003 (Government Gazette A’ 116/16.05.2003) and Decision 31619 Government Gazette 969/22.3.2017 as well as the adaptation of Greek legislation to Directive 2011/83/EU of the European Parliament and Council of October 25, 2011, regarding consumer rights, amending Council Directive 93/13/EEC and Directive 1999/44/EC of the European Parliament and Council and repealing Council Directive 85/577/EEC and Directive 97/7/EC of the European Parliament and Council, published in the Official Journal of the European Union, number L 304 of 22.11.2011 as it came into effect from 13/06/2014. The user has the right to make a valid order through the electronic store, provided they are legally competent following the provisions of the Greek Civil Code (having completed the eighteenth year of age and not under judicial assistance regarding sales contract conclusion). Orders can also be made by legal representatives of legal entities. Our company reserves the right to demand return from the supervisor or guardian of any orders made by legally incompetent persons.

Placing Orders through the Electronic Store

To place an order in our electronic store requires:
– Completion of the special form with necessary details for sales contract conclusion
– Unconditional acceptance of sales contract terms and usage terms, particularly data collection and where required, personal data use.

On all pages of the electronic store www.artcolour.gr and next to each available product for purchase, there is an “add to cart” button. Navigate our electronic store and add the products you wish to purchase to your cart.

To continue shopping, select from the main categories the one containing the next item you’re looking for and add it also to your cart. When you complete the product addition process, press the “CHECKOUT” button. To place an order, it’s not necessary to be a member of the electronic store www.artcolour.gr, but we would recommend becoming a member, as it will make the entire process much easier for any future use of our electronic store.

Complete the form with the username and access code you declared during registration and select “LOGIN” in the members area. If you’re not a member, press the new account creation button and complete the new member registration form with an active email account. The email you declare must exist because our communication will also be through the email you declared during registration.

Even if you don’t become a member, you will be asked for personal information such as: billing and order delivery address, email, contact telephone, information necessary for concluding and completing the contract between the two parties.

Οι όροι και οι προϋποθέσεις που περιγράφονται σε αυτή την πολιτική ισχύουν για όλα τα προϊόντα που αγοράζονται στην Ελλάδα μέσα από το ηλεκτρονικό κατάστημα www.artcolour.gr.

Order cancelation

Όταν κάνετε την παραγγελία σας μέσω του ηλεκτρονικού καταστήματος www.artcolour.gr, έχετε τη δυνατότητα να ακυρώσετε την παραγγελία σας μέσα στην ίδια ημέρα που κάνατε την παραγγελία. Για τυχόν επιστροφή των προϊόντων σας μπορείτε να μας στέλνετε το αίτημά σας γραπτώς με e-mail στο info@artcolour.gr.

Για οποιαδήποτε πληροφορία χρειάζεστε, μπορείτε να επικοινωνείτε μαζί μας συμβουλευόμενοι τα στοιχεία επικοινωνίας του site μας (Επικοινωνία). Τα προϊόντα που θέλετε να επιστρέψετε θα πρέπει να είναι σε άριστη κατάσταση, με κλειστή συσκευασία. Είστε υπεύθυνοι για το κόστος επιστροφής των προϊόντων εκτός αν το προϊόν εμπίπτει σε θέματα εγγύησης λόγω κατασκευαστικού ελαττώματος. Σε περίπτωση που ανοίξετε τη συσκευασία του προϊόντος θα πρέπει να φροντίσετε να το επιστρέψετε σε άψογη κατάσταση, μαζί με όλα τα μέρη και τα εξαρτήματα από τα οποία αποτελείται.
Συμφωνείτε να φροντίζετε την κατάσταση των επιστρεφόμενων προϊόντων από τη στιγμή που παραδοθούν σε εσάς μέχρι τη στιγμή που τα παραδώσετε στο κατάστημα μας ή στη μεταφορική εταιρεία ή την εταιρεία ταχυμεταφοράς (courier). Η εταιρεία μας δεν ευθύνεται για ελαττώματα ή κακή ποιότητα των προϊόντων που διαθέτει στους πελάτες του. Όλα τα προϊόντα παραλαμβάνονται από τους προμηθευτές συσκευασμένα.

Σε περίπτωση που στα παραδιδόμενα προϊόντα αποδεδειγμένα ανευρεθεί ελαττωματικό προϊόν, διατηρείτε το δικαίωμα επιστροφής και αντικατάστασής του με δικά μας έξοδα αποστολής. Σε περίπτωση που δεν επιστραφούν εντός 15 ημερών τότε η εταιρεία μας δύναται να μην αποδεχτεί την όποια επιστροφή ή αντικατάσταση προϊόντος. Σε κάθε περίπτωση το ανώτατο χρονικό περιθώριο επιστροφής για αντικατάσταση δεν δύναται να παραταθεί πέραν των δεκαπέντε (15) ημερολογιακών ημερών από την ημερομηνία παραλαβής.
Εκτός των δικαιωμάτων που παρέχονται με την πολιτική επιστροφών, αναγνωρίζονται σε κάθε περίπτωση όλα τα δικαιώματα που ισχύουν για τους καταναλωτές από τις υπάρχουσες διατάξεις και τους νόμους σχετικά με τη σύμβαση πώλησης, καθώς και οποιοδήποτε δικαίωμα προκύπτει σε σχέση με τους όρους εγγύησης των προϊόντων.

Μεταφορά επιστρεφόμενων προϊόντων

Σε περίπτωση που επιθυμείτε να επιστρέψετε εμπορεύματα λόγω αλλαγής γνώμης, επιβαρύνεστε με την άμεση δαπάνη επιστροφής των προϊόντων. Η παραλαβή των επιστρεφόμενων προϊόντων θα μπορεί να πραγματοποιείται μόνο από τη διεύθυνση που είχατε δηλώσει εξαρχής για την αποστολή τους και την οποία μας έχετε υποδείξει γραπτώς.
Συμφωνείτε να δώσετε στην εταιρεία μας όσο το δυνατό περισσότερες λεπτομέρειες για τη διεύθυνση παραλαβής των εμπορευμάτων, για παράδειγμα όροφος, δυσκολίες πρόσβασης του μεταφορέα/courier, ύπαρξη ασανσέρ, στενές σκάλες, κτλ., προκειμένου να διευκολυνθεί η διαδικασία παραλαβής από το χώρο που θα μας υποδείξετε.

Συμφωνείτε ότι θα υπάρχει κατάλληλη πρόσβαση στο χώρο για την παραλαβή των επιστρεφόμενων εμπορευμάτων.
Αν ο μεταφορέας/courier θεωρήσει ότι η παραλαβή των προϊόντων από το χώρο που θα υποδείξετε, μπορεί να προκαλέσει φθορά στην περιουσία σας, θα σας ενημερώσει προφορικώς και θα το καταγράψει στο έντυπο παραλαβής. Μπορεί να υποδείξετε στη συνεργαζόμενη εταιρεία μεταφορών/courier να συλλέξει τα προϊόντα παρά την υπόδειξη αυτή, παρόλα αυτά δε θα είμαστε υπεύθυνοι για οποιαδήποτε ζημία μπορεί να προκληθεί στην περιουσία σας ή τα εμπορεύματα δεδομένου ότι η συλλογή των προϊόντων θα γίνει με την πρέπουσα προσοχή και φροντίδα.
Συμφωνείτε να δώσετε στο συνεργάτη όλα τα προϊόντα που επιθυμείτε να επιστρέψετε, συμπεριλαμβανομένων όλων των μερών και των εξαρτημάτων που τα απαρτίζουν. Κατά την παραλαβή των επιστρεφόμενων προϊόντων από το μεταφορέα θα υπογράψετε ένα έντυπο παραλαβής για να πιστοποιήσετε ότι πραγματοποιήθηκε η παράδοση στο μεταφορέα. Το έντυπο παραλαβής θα σας δοθεί από το συνεργαζόμενο μεταφορέα/courier.
Αν δεν δύναστε να είστε ο ίδιος παρών κατά την παραλαβή των εμπορευμάτων από το χώρο, μπορείτε να ορίσετε ένα εκπρόσωπο που θα αναλάβει αυτή τη διαδικασία εκ μέρους σας. Ο εκπρόσωπος αυτός θα πρέπει να είναι ενήλικος και ικανός να επιβλέψει την παραλαβή των προϊόντων σας αντί για εσάς.

Επιστροφή αντίτιμου αξίας επιστρεφόμενων προϊόντων
Εφόσον πληροίτε τις προϋποθέσεις επιστροφής, θα σας επιστρέψουμε το ποσό που αναλογεί στην αξία των εμπορευμάτων που επιστρέφετε με τον ίδιο τρόπο που πραγματοποιήσατε την αρχική συναλλαγή εκτός αν επιθυμείτε άλλο τρόπο επιστροφής για τον οποίο θα πρέπει να μας ενημερώσετε γραπτώς. Η επιστροφή του αντίτιμου των επιστρεφόμενων προϊόντων θα πραγματοποιείται το συντομότερο δυνατό. Σε κάθε περίπτωση, θα πραγματοποιείται αφού μας ενημερώσετε γραπτώς για το αίτημα επιστροφής των προϊόντων και εμείς δεχτούμε την επιστροφή τους καθώς και εφόσον τα προϊόντα έχουν παραδοθεί στη συνεργαζόμενη εταιρεία μεταφοράς/courier.

Εξαιρέσεις από το δικαίωμα υπαναχώρησης
Το δικαίωμα υπαναχώρησης δεν ισχύει όσον αφορά στις ακόλουθες περιπτώσεις:

Την προμήθεια αγαθών που κατασκευάζονται σύμφωνα με τις προδιαγραφές που έχετε θέσει εσείς ως καταναλωτής ή σαφώς εξατομικευμένων (Προϊόντα Ιδιωτικής Ετικέτας – Private label)

Την προμήθεια αγαθών τα οποία, μετά την παράδοση, λόγω της φύσης τους, είναι αναπόσπαστα αναμεμειγμένα με άλλα στοιχεία

Other

Ανωτέρα βία: Αν για λόγους ανωτέρας βίας (π.χ. κακές καιρικές συνθήκες, απεργίες κλπ) δεν είναι δυνατό να σας παραδώσουμε τα προϊόντα εντός του προκαθορισμένου χρόνου θα σας ενημερώσουμε τηλεφωνικά ή μέσω e-mail, προκειμένου να μας δηλώσετε αν επιθυμείτε, υπό αυτές τις συνθήκες, την ολοκλήρωση της παραγγελίας σας. Η εταιρεία μας δεν φέρει καμία ευθύνη για όποια κατάσταση είναι εκτός δικής της υπαιτιότητας και θα κάνει ότι είναι ανθρωπίνως δυνατό για την καλύτερη δική σας εξυπηρέτηση.
Σε περιπτώσεις που έχετε καταχωρήσει μια ηλεκτρονική παραγγελία και κατά την παραλαβή διαπιστώνετε ότι λείπει κάποιο ή κάποια προϊόντα από τη συνολική παραγγελία, παρακαλούμε επικοινωνήστε μαζί μας, ώστε να διευθετήσουμε όλες τις λεπτομέρειες που απαιτούνται και να σας αποστείλουμε τα προϊόντα που δεν παραλάβατε χωρίς καμία επιπλέον επιβάρυνση.
Τροποποίηση των όρων του παρόντος:

Η εταιρεία μας διατηρεί το δικαίωμα να τροποποιεί ή να ανανεώνει τους όρους και τις προϋποθέσεις συναλλαγών. Αναλαμβάνει δε την υποχρέωση να ενημερώνει το παρόν κείμενο για οποιαδήποτε αλλαγή ή προσθήκη στους όρους.

Σε περίπτωση μη παραλαβής των παραγγελθέντων εμπορευμάτων (και εφόσον έχει παρέλθει μεγάλο χρονικό διάστημα από την καταχώρηση της παραγγελίας), παρακαλούμε επικοινωνήστε με την εταιρεία μας. Για την καλύτερη και γρηγορότερη εξυπηρέτησή σας, θα σας συνιστούσαμε να αναφέρετε τον ειδικό κωδικό παραγγελίας που έχει αποσταλεί στη διεύθυνση e-mail που δηλώσατε κατά την παραγγελία σας. Σύμφωνα με την Οδηγία 2013/11/ΕΚ, η οποία ενσωματώθηκε στην ελληνική νομοθεσία με την ΚΥΑ 70330/2015 και την Απόφαση 31619 ΦΕΚ 969/22.3.2017 (άρθρο 8) προβλέπεται η δυνατότητα ηλεκτρονικής επίλυσης καταναλωτικών διαφορών με τη διαδικασία Alternative Dispute Resolution στο σύνολο της Ευρωπαϊκής Ένωσης.

Εάν ο Πελάτης έχει πρόβλημα με αγορά που πραγματοποίησε από το Ηλεκτρονικό Κατάστημα και διαμένει στην ΕΕ μπορεί να χρησιμοποιήσει τον ιστότοπο Σελίδα Επίλυσης Διαφορών για εξωδικαστική διευθέτηση της διαφοράς.
